Purpose of an application for a patent or a utility patent
It should achieve the broadest possible scope of
protection. Therefore, the main claim
should be drafted as generally as possible, but must accurately and correctly reflect the core idea of the invention.
The application has be completed with a
sufficient number of subclaims for an opportunity to have a strategic
withdrawal. Required is the description of the current state of the art and
the invention, so that the novelty and the inventive step of the idea
can be recognized by comparison.
The worst case of an improper application is that the core idea is published, but the wording of the main claim only
allows an imperfect scope of protection. Although the application can
be corrected within one year after filing and within the limits of the original statement, this is difficult and time-consuming without a skilled
